What categories of data do we use and where do they come from?

The following data will be collected and processed for the automated processing of your application:

  • First name, last name, e-mail and, if applicable, address/city, date of birth, title, telephone number, citizenship
  • Additional questions depending on the respective advertisement (e.g., driving licence)
  • Curriculum vitae, in particular information on professional experience and training
  • Skills (e.g. Photoshop, MS Office)
  • Application photo
  • Qualifications, awards and language skills
  • Letter of motivation
  • Files and documents you upload, if applicable
  • The written electronic communication that takes place between you and us.

As a rule, your personal data will be collected directly from you as part of the application process.

For what purposes and on what legal basis is data processed?

We process your personal data in compliance with the provisions of the EU General Data Protection Regulation (GDPR), the German Federal Data Protection Act (BDSG) and all other applicable laws.

The primary purpose of data processing is to decide on the establishment of an employment relationship. The primary legal basis for this is Art. 6 para. 1 b) DS-GVO in conjunction with § 26 para. 1 BDSG and, if applicable, your separate consent pursuant to Art. 6 para. 1 a), 7 DS-GVO in conjunction with § 26 para. 2 BDSG.

Where necessary, we also process your data based on Art. 6 para. 1 f) DS-GVO and § 15 AGG to protect the legitimate interests of us or third parties (e.g., authorities). This applies to the investigation of criminal offences (legal basis § 26 para. 1 p. 2 BDSG) or internal communication and other administrative purposes.

If we want to process your personal data for a purpose not mentioned above, we will inform you in advance.

Who gets your data?

Within our company, only those persons and departments (e.g., specialist department) receive your personal data that require it to fulfil our contractual and legal obligations.

Within our group of companies, your data will be transferred to certain companies if the advertised position is in one of these companies or if they centrally perform data processing tasks for the companies affiliated in the group.

Recipients within the audius group may be the following companies:

Outside of our company, we use Bitwerk GmbH & Co. KG as a service provider for the operation of the e-recruiting system "Staff Expert".

Within the scope of these activities, Staff Expert shall process personal data on behalf of and for the purposes of audius SE.

Furthermore, there is the possibility that we must pass on your data to public authorities due to overriding legal provisions. In addition, we may transfer your data to other external bodies, insofar as you have given your consent, or a transfer is permissible due to overriding interest.

Recipients outside the audius Group:

What data protection rights can you assert as a data subject?

You can request information about the data stored about you at the above address. In addition, you can request the correction or deletion of your data under certain conditions. You may also have the right to restrict the processing of your data and the right to receive the data you have provided in a structured, common, and machine-readable format.

Right of objection

You have the right to object to the processing of your personal data for direct marketing purposes without giving reasons. If we process your data to protect legitimate interests, you may object to this processing on grounds relating to your situation. We will then no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

How long will your data be stored?

We delete your personal data as soon as they are no longer required for the above-mentioned purposes. After completion of the application process, your personal data will be deleted after 6 months if your application is not successful.

In the event of a successful application, your personal data will be stored for as long as we are legally obliged to do so. This regularly results from legal obligations to provide proof and to store data, which are regulated, among other things, in the German Commercial Code (Handelsgesetzbuch) and the German Fiscal Code (Abgabenordnung). The storage periods are then up to ten years. In addition, personal data may be stored for the time during which claims can be asserted against us (statutory limitation period of three or up to thirty years).

Will your data be transferred to a third party?

Data will not be transferred to a third party.

Are you obliged to provide your data?

As part of your application, you must provide the personal data required to decide on the establishment of an employment relationship. Without this data, we will not be able to carry out the application process with you.

To what extent do automated individual decisions or profiling measures take place?

Automated individual case decisions or profiling measures do not take place.
